Privacy

  1. Please read this Privacy section carefully, as it affects your rights and liabilities under the law.  If you do not agree with any term or condition in this Privacy section, you cannot use our app.
  2. Your privacy is important to us. We are committed to protecting your right to privacy and providing you with a safe and secure user experience. Under this section, we explain how we collect, store and use the information that You provide to us through our app. By accessing and using our Plant-It app, you explicitly accept, without limitation or qualification, the collection, use and transfer of the personal information and non-personal information in the manner described in this Privacy Policy.
  3. We endeavor to safeguard and protect your information.
  4. You acknowledge and consent to our collection, use and disclosure of your personal information as it is critical for your use and access to our app. Subject to certain legal or contractual restrictions and reasonable notice, you may withdraw this consent at any time. We will inform you of the consequences of withdrawing your consent. Unless permitted by law to do so, we will not collect, use and disclose your personal information without your consent. 
  5. We collect specific personal information relating to Full Name, Postcode, Country, Email Address, and Phone Number from You when You visit and use our app. 
  6. We do not collect credit card number(s), bank account information and related information on our app.  
  7. We will never knowingly collect any personal information from children under the age of 18.  If we obtain actual knowledge that we have collected personal information about a child under the age of 18, that information will be immediately deleted from our database.  If your child has submitted his or her name through our app, and you wish to communicate with us, please do so by contacting us immediately.
  8. We will only collect information for the purposes of the Promotion.
  9. We disclose your information if legally required to do so, or at our discretion, pursuant to a request from a governmental entity, or if we believe in good faith that such action is necessary to (a) conform to legal requirements or comply with legal process; (b) protect our rights or property, or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.
  10. We will retain information collected, used, and disclosed for a minimum period of six (6) months and a maximum period of eighteen (18) months from the latest date of your access, use and purchase on the app unless otherwise agreed upon.
  11. Personal information collected through our online contact form becomes part of a contact list and is kept until the individual unsubscribes. When personal information has been used to decide about a specific individual, that information will be available to the individual for a minimum of six (6) months and a maximum of eighteen (18) months from the date of the decision. In the event a request for personal information has been refused, the personal information relating to that request shall be retained for a minimum of six (6) months and a maximum of eighteen (18) months from the date refusal was delivered, not received. Once collected information has expired, it will be destroyed, erased, or made anonymous.
  12. We keep the Personal Information that we collect at our offices at our storage service providers in Dublin, Ireland. We may, from time to time, also hold your personal information in connection with the purposes for which you provided your consent.
  13. Your personal information may be transferred to other countries for processing. By using the app, you consent to the transfer of information to countries outside of your country of residence, which may have different personal data protection rules than in your country.
  14. You have the following rights to the processing of your personal information under relevant privacy laws – the California Consumer Privacy Act (CCPA) –
    1. To keep your personally identifiable information accurate, current, and complete, please contact us as specified below. We will take reasonable steps to update or correct personally identifiable information in our possession that you have previously submitted via our app.
    2. You have the right to receive a subset of the personal information you provide to us if we process it. If you want us to transfer your personal information to another party, you can contact us and we will respond on the feasibility of your demand. It is possible to transfer such information, we will not be responsible for the security of personal information or its processing once received by the third party. 
    3. You have the right to require us to correct any of your personal information which is inaccurate or have incomplete data. Where you request a correction, please explain in detail why you believe the personal information we hold about you to be inaccurate or incomplete so that we can assess whether a correction is required.
    4. You have a right to require us to stop processing the personal information we hold about you other than for storage purposes in the following circumstances: 
      1. You believe the personal information is not accurate for the period it takes for us to verify whether the data is accurate;
      2. We want to erase the personal information, but you want us to simply restrict the use of that data;
      3. We no longer need the personal information for the processing, but you require us to retain the data for the establishment, exercise, or defense of legal claims; or
      4. You have objected to us processing personal information we hold about you based on our legitimate interest and you wish us to stop processing the personal information while we determine whether there is an overriding interest in us retaining such personal information.
    5. You have the right to object to our processing of data about you and we will consider your request. Please provide us with detail as to your reasoning so that we can assess whether there is a compelling overriding interest in us continuing to process such data or we need to process it concerning legal claims. You may contact us at treeplantinglegal@plantit.com.
    6. You may unsubscribe at any time from our mailing list. 
    7. As a Texan resident, you have certain rights with respect to your personal data, subject to any exemptions provided by the law, including the rights to:
      1.  Request access to your personal data;
      2. Request correction or deletion of your personal data;
      3.  Object to our use and processing of your personal data;
      4. Request that we limit our use and processing of your personal data; and 
      5. Request portability of your personal data.
      6. You also have the right to make a complaint to a government supervisory authority.
    8. If there is a data breach, we have sixty (60) days to inform you of such breach, the extent of investigation, and measures we have taken to resolve the issue.
    9. If you want to exercise any or all of your rights, please submit a request including your Full Name, means of identification, and a brief explanation of your request by contacting us. via the contact information provided below. We shall comply with your request in less than ten (10) business days provided your request does not prove impossible or involve disproportionate effort for us to comply.
  15. We reserve the right to make material changes to the substance of this section and to this Terms.
